By using these App/web services, you acknowledge and indicate that you have read, understood, and you are agreeing to obey with and be bound by these terms and conditions. If you are refusing to accept the terms and conditions then you may not use this app/web services.

SCOPE:

The main motto behind the onruto is drivers are unable to find trips and in major scenarios after unloading they have to come back with empty trucks.

Due to lack of communication between the customers and truck drivers, this emerging platform can be perfect to fill the gap between customers and drivers, so it can eventually eradicate the financial problems.

onruto not only favours the skilled drivers but also in favour of People who are suffering to move single/few items/emergency movable goods due to lack of communication/Transportation.

onruto web/app is without expecting any commission from drivers, as the amount offered by customers goes directly into drivers hand.

Inside every problem lies an opportunity, the problem which common people and drivers are facing, we tried to create an opportunity in the name of onruto. onruto app/web is providing a platform for moving goods of customers with drivers who are going on specified routes with empty trucks.

TERMS AND CONDITIONS FOLLOWED BY USERS OR DRIVERS OR VEHICLE OWNERS;

We are providing a platform between vehicle owners, drivers and consignor or consignee.

User or consignor or consignee is a very respectable person to us. We should show special respect with good behavior towards the user or consignor and consignee. In case the driver is misbehaving or violating the instructions given by the user or consignor or consignee. Then the consignor can raise a complaint with onruto web/app contact support, so onruto will have a look into it to take suitable action on it like suspension/termination.
onruto app/web displays goods to move from one point to other point. If you are interested and take all responsibilities according to user or consignor or consignee instructions you can proceed with the booking. Onruto web/app connects drivers and consignor, after connecting the company will not interfere with your commitments, goods damages, losses and other disputes or any issues.

Consignor or consignee have the right to decide the price of moving goods If you are interested then proceed to bid but don’t misbehave or don’t use unparliamentary language in the request section. If you violate these conditions then the company has the right to terminate/deactivate your account.

Drivers have to check carefully about their booking commitments before accepting or bidding with users or consignor or consignee.

Driver need to record all consignor or consignee calls it helps for evidence purposes and also take pictures of goods while loading then you have evidence for any miscommunication/damages of product happen between you and consignor or consignee.

Driver needs to check all legally authorised movable goods then only proceed to load into your truck. If a driver finds any single item is smuggled or theft or illegal on consignee or consignor movable goods then must refuse that booking.

Driver can take all responsibilities about goods while moving from one point to another point, if it causes arly damages and thefts and losses.

Drivers should not ask any advance after confirmation of booking with consignee or consignor. Advance should take only after loading goods in a truck.

Drivers should clarify their doubts before accepting the order, once the deal is done (confirmed booking) with customer and driver there should not be any sort of modifications accepted.

Onruto web/app shall not be liable for any damages, losses, liabilities, costs and expenses arising out of or related to use or misuse of the services due to technical fault/error or any failure in the network or any error in any software services.

onruto app/ web would not take responsibility regarding contract payment terms or pricing entered between vehicle owner or driver and consignor or consignee using this app as a platform.

onruto app/web is not responsible for any natural loss, theft, accident, damage, natural calamity, act of God, war, terrorism, armed conflict, labour strike, lockout, or boycott or any other similar cause.

Consignor or consignee have a chance to cancel booking without informing to you, so drivers must take confirmation of booking before going to pickup location.

onruto app/web is not liable for any early pickup, early delivery. late pickup, and late delivery, any waiting charges will be confirmed with consignor or consignee before accepting your truck by consignor or consignee. Drivers are responsible in case of any breakdown then make certain arrangements to reach the pickup and delivery on time.

If drivers commit any illegal things to the consignor or consignee then the company provides all your personal details to those consignor or consignee for legal proceedings.

Driver should not cancel any bookings without intimation, if you repeat cancellations your account will be suspended without any intimation and also you are charged a fine. 

Drivers should not take sensitive/fragile items and if any customer requests to move such fragile items then take a notice for the damage of goods are responsible by customer.

Driver use the service to ship items at your own risk and agree that onruto web/app shall have no liability for any damages or losses of shipped items.

Drivers are instructed that if you repeatedly cancel bookings after accepting your request by consignor or consignee, your account termination chances are high.

You are solely responsible for obtaining any insurance to cover any anticipated losses Requested pick-up and delivery dates and hours will not require the Carrier to violate hours of service regulations under applicable law; and

You are solely responsible for any and all liability, which results or is alleged as a result of such shipped items, including, but not limited to, property damage, personal injury and death.

We will not ask the driver to break any Traffic/RTO/City Police and/or government rules for any purpose. The driver has the right to refuse such a reqijest by the customer. The driver also has the right to refuse such a pick-up.

Driver has the right to refuse the order when the truck is overloaded than the allowed limit of the truck.

A chauffeur should not misbehave/speak vulgarly with passengers. If you violate these conditions then the company has the right to terminate/deactivate your account and you will face actions as per law.

The company reserves all rights to add, delete, modify, alter, update, etc. From time to time, any or all features and services offered, which are existing/may be maintained anytime in future.

If onruto determines at its sole discretion that You have breached any obligation or that You have breached one or

more booking Contracts, it reserves the rights to remove any content, Posted booking or Offer You have submitted to the onruto Service or cancel or suspend Your account and/or any Task Contracts.

All drivers must follow booking timings because passengers and consignor or consignee give their time according to their valuable dally schedules. 

Amendments To Terms

onruto web/app may amend Terms at any time by posting the amended terms on this site. It is your responsibility to review these Terms periodically.

Your continued use of the Platform following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page frequently so you are aware of any changes, as they are binding on you.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use Service.

GOVERNING LAW

This Agreement and any dispute or claim arising out of or in connection with it or its subject matter or formation shall be governed by and construed in accordance with the laws of telangana, India, to the exclusion of conflict of law rules.

Limitation of liability:

onruto web/app entire llability, and your exclusive remedy, in law, in equity, or otherwise, with respect to the website content/

Services and/or for any breach of this agreement is solely limited to the amount you paid, less shipping and handling charges, for Services purchased via this website. onruto will not be liable for any direct, indirect, incidental, special or consequential damages in connection with this agreement &/or Services in any manner, including liabilities resulting from: the use or the inability to use the website content / Services; the cost of procuring substitute content / Services; any information obtained / Services purchased or transactions entered into through the website; or any lost profits you allege. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages so some of the above limitations may not apply to you.

In conjunction with the Limitation of Liability as explained above, you expressly understand and agree that any claim against us shall be limited to the amount you paid, if any, for use of Services, onruto will not be liable for any direct, indirect, incidental, consequential or exemplary loss or damages which may be incurred by you as a result of using our Resources / Services, or as a result of any changes, data loss or corruption. cancellation, loss of access, or downtime to the full extent that applicable limitation of liability laws apply.

For the proper operation of the onruto Platform (including insurance, proper pricing and compliance with Policies), the consignor must ensure that, if it subcontracts any part of the performance of the Services to a third party in accordance with a Task Contract, then that third party must also be a registered User of the onruto Platform.
Respective points of this terms and conditions are applicable to passenger vehicle drivers.

Content:

onruto web/app service allows you to post, link, store and otherwise make available certain information, text, graphics, or 

other material (“Content”). You are responsible for Content that you post on or through Service, including its legality, reliability. and appropriateness.

By posting Content on or through Service, You represent and warrant that: (1) Content is yours (you own it) and/or you have the right to use it and the right to grant us the rights and license as provided in these Terms, and (ii) that the posting of your Content on or through Service does not violate the privacy rights, publicity rights, copyrights, contract rights or any other rights of any person or entity. Waiver of Class Action Rights: BY ENTERING INTO THIS AGREEMENT, YOU HEREBY IRREVOCABLY WAIVE ANY RIGHT YOU MAY HAVE TO JOIN CLAIM WITH THOSE OF OTHERS IN THE FORM OF A CLASS ACTION OR SIMILAR PROCEDURAL DEVICE. ANY CLAIMS ARISING OUT OF OR RELATING TO OR IN CONNECTION WITH THIS AGREEMENT MUST BE ASSERTED INDIVIDUALLY.

Effect of Waiver:

The failure of us to exercise or enforce any right or provision of this Agreement will not constitute a waiver of such right or provision. If any provision of this Agreement is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavour to give effect to the parties’ intentions as reflected in the provision and the other provisions of this Agreement remain in full force and effect.

Cessation of Operation: 

onruto web/app may at any time, in its sole discretion and without advance notice to you, cease operation of the Website and distribution of the Services.

Termination:

onruto reserves the right to terminate your access to the Website if it reasonably believes, in its sole discretion, that you have breached any of the terms and conditions of this Agreement. To Impersonate or attempt to impersonate a company, a Company employee, another user, or any other person or entity.

In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful, or in connection with any unlawful, illegal, fraudulent, or harmful purpose or activity.

To engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of Service, or which, as determined by us, may harm or offend Company or users of Service or expose them to liability.

Domestic Use:

onruto makes no representation that the Website or Services are appropriate or available for use in locations outside India. Users who access the Website from outside India do so at their own risk and initiative and must bear all responsibility for compliance with any applicable local laws.
